The 2018 Farm Bill Loophole & Why It Matters Today
The 2018 Farm Bill legalized hemp with less than 0.3% Delta-9 THC, but it did not account for other intoxicating cannabinoids (like Delta-8) that can be chemically converted from hemp. This created a loophole that allowed psychoactive products to be sold outside the regulated cannabis system, often without testing, age controls, or quality standards. This week, the Senate advanced language to close that loophole by capping total THC content of hemp products at 0.4mg and clarifying product definitions.
If signed into law, these changes could bring greater consumer safety, product consistency, and a more level competitive landscape by ensuring intoxicating THC products follow the same regulatory standards as state-licensed cannabis.
Fun Fact: The hemp-derived cannabinoid market represents approximately $17.8 billion in annual sales, operating largely outside the regulated state-licensed cannabis marketplace. (Source: Whitney Economics, 2023 Hemp Cannabinoid Market Analysis.)
